Scope of the Agreement
The agreement establishes the basis
upon which the Polytechnic of Central London (University of
Westminster) recognises the Trade Unions who are
signatories to this document. It provides the necessary procedures
to govern relations between the Polytechnic of Central London and
those Trade Unions.
The purpose of this agreement is to
establish local consultative and negotiating arrangements to cover
all groups of staff within the Polytechnic of Central London up to
but not including Deans of School and Heads of Administrative
Departments.
The agreement does not cover members
of the Senior Management Group, this Group includes the Rectorate,
Deans, Financial Controller and the Director of Information
Resource Services; Heads of Administrative Departments and the
Deputy Director of Information Resource Services; holders of senior
posts as described in the Articles of Government of the Polytechnic
of Central London; holders of posts requiring involvement in
matters of a negotiating, fiduciary or highly confidential nature
as identified by job description; and Deans of School.
Objectives
The signatories to this document
agree to promote harmonious employee relations through the
development of effective joint consultative and negotiating
procedures as contained in this Agreement.
The signatories to this document
agree that while all efforts will be made to resolve matters of
common concern through consultation and negotiation, the final
responsibility for the planning, reward, organisation, approval and
review of staffing resources of the Polytechnic rests with
management.
The signatories to this document
recognise the right of all employees to belong or not to belong to
a Trade Union.
The signatories to this document
recognise that it is of common interest that those who wish to join
a Trade Union should be encouraged to belong to a Trade Union
recognised by this Agreement.
The signatories to this document
agree that only Trade Union Representatives formally accredited by
a recognised Trade Union will be recognised by the Polytechnic Of
Central London for purposes of negotiation and consultation.
The signatories to this document
agree that it is the Polytechnic of Central London's responsibility
and right to plan, organise and manage its establishments so as to
obtain efficient and effective academic, technical and
administrative operations by all reasonable means.
The signatories to this document
agree that the Agreement in no way detracts from or lessens the
requirement for direct communication between individual employees
and the employer.
The signatories to this document
agree to implement agreements reached within the Polytechnics and
Colleges National Negotiating Committee (PCNNC) and accept that the
Polytechnic may wish to substitute in part. This is further
explained in 3.11.
Procedures for Negotiation and
Consultation
The recognised Trade Unions accept
the requirement for TUC and non-TUC affiliated Trade Unions to
jointly convene meetings with management within the terms governed
by this document.
Negotiations will take place between
the nominated representatives of the Rector and accredited
representatives of the recognised Trade Unions.
Meetings for negotiating purposes
will normally take place between not more than three nominated
representatives of the Rector and not more than three Trade Union
representatives from any one Trade Union. When negotiating with a
common interest group there should be no more than five Trade Union
members, membership to be determined by the common interest group
with due regard to the number of members in the constituent unions.
One full-time official from each Trade Union may attend ex-officio
as a member of the Trade Union group.
While certain matters will need to
be negotiated collectively since they will be pertinent to all
Trade Unions, it is expected that other matters will be negotiated
either directly between one Trade Union and management or between a
recognised common interest group of Trade Union(s) and
management.
The common interest groups will
be:
Academic Staff : NATFHE and
APCT
APT & C Staff : NALGO and
NUPE
Manual Staff : NUPE
Meetings for negotiating purposes
between the management and the recognised Trade Unions
individually, collectively or any of the common interest groups may
be initiated by management or the Trade Unions and will be convened
by management.
Meetings for negotiating purposes
will be arranged with the least delay, providing their purpose is
clear.
Meetings for negotiation will be
chaired by the senior member of management present.
Meetings for consultative purposes
will take place on at least a termly basis. The management and the
recognised Trade Unions will have due regard to the need to limit
the number of representatives attending consultative meetings to
ensure efficient and speedy resolution of mutually agreed agenda
items.
Meetings for consultation will be
chaired alternately by the Trade Union and management, the Chair
alternating on a yearly basis.
In the context of 2.7 matters for
negotiation and consultation will be confined to:-
i) general salary increases and
salary structure for relevant employees;
ii) matter directly affecting the
terms and conditions of employment of relevant employees;
iii) matters relating to the
performance of the Polytechnic of Central London as they affect
directly the relevant employees;
iv) other such matters as may be
mutually agreed.
When entering into negotiation, it
is the intention of management not to worsen national agreements,
although variations in national settlements may be locally
agreed.
Procedures for the Avoidance of Disputes
This procedure is available for the
consideration of collective issues which have not proved possible
to resolve in formal discussions. It provides for the consideration
and resolution of disputes in the form of problems and issues
raised on behalf of members by the recognised Trade Union.
Before matters of difference are
brought to a joint meeting of senior management and Trade Union(s)
it is agreed that every reasonable endeavour will have been
taken to resolve the matter with local management.
If agreement cannot be reached at
the joint meeting which may include a full-time Trade Union
official, the parties may, if mutually agreed to do so, refer it to
conciliation by an agreed third party or, to arbitration by an
agreed arbitrator, both parties first reaching agreement on the
terms of reference.
It is agreed that until stages 4.2
and 4.3 are exhausted, there will be no departure from normal
working.
Should resolution prove impossible
after all stages have been exhausted, management shall notify the
Trade Unions in writing of changes imposed. The Trade Union agrees
to give the Rector or nominees advance notice in writing of any
industrial action it proposes to take against the Polytechnic of
Central London. It is mutually agreed that each party shall give
the other seven days' notice of the imposition of management
decisions or industrial action.
If the dispute relates to
recommendations of the PCNNC, reference may be made to the
Secretaries of the management and union sides should both parties
locally decide to request such referral.
Trade Union Facilities
This agreement commits the
signatories of this document to establish reasonable arrangements
concerning use of notice boards and Polytechnic equipment.
This agreement commits the
signatories of this document to provide Trade Union paid time off,
check-off, meeting facilities, staff training and other matters as
soon as possible after signing this agreement.
These arrangements will be
determined by Appendix I.
Termination of Agreement
This agreement replaces any previous
agreement made between the parties and is effective from 1 February
1991 and may be terminated by one party giving the other twelve
months notice in writing.
